Dear Sirs,
On 3rd of March 2014, an important Report on the protection of children against the excesses of the socalled
cults and which is the result of long and accurate efforts of the French rapporteur Rudy Salles, has
been adopted by the Committee of Legal Affairs and Human Rights of the Parliamentary Assembly of the
Council of Europe.
Scholars, Italian associations for the protection of children’s right, centres and association of research,
information and protection of individuals and families against high-risk groups that all together sign this
letter, wish to express their sincere gratitude and appreciation for the Report’s content, which in this case
identifies and suggests essential programmes and intervention policies and/or their strengthening, in order
to face effectively the danger represented by the so-called cults and protect concretely the interest of the
child from all forms of brutality, abuse and negligence.
We can only hope for its approval, certain that the Parliamentary Assembly and the Council of Europe play
a key role in contrast to this worrying social phenomenon, which is constantly growing and involves an
increasing number of adolescents and children also through the increased use of Internet.
International scientific contributions report unanimously that minors introduced in abusing cult contexts
often suffer the systematic violation of their fundamental rights (Paul Martin, Michael D. Langone and Gary
Eisenberg, Markowits and Halperin, Susan Landa, Stephen A. Kent and Doni Whitsett, Singer and Lalich,
etc.), as Jill Mytton’s recent research published by The British Psychological Society (1) has highlighted that
children born and raised within high-risk groups will present significant psychological and psychosocial
problems, not only after leaving the group but also in their adulthood. In addition, on the basis of the
results of an accurate study carried out by the University of Toronto (2), children who are victims of
coercive realities will present more prolonged remission periods of depression than those who were not
subject to this kind of traumas. As far as we know, another important research project approved by Human

Subjects in Research Committee at California State University, is in progress. Its title is "On Our Own: How
Children Of Cults Manage to Survive in the ‘Outside’ World" by Dr. Jania Lalich, renowned international
expert on cults and extremist groups.
In our activities, we are in daily contact with people who are victims of totalitarian organisations and
manipulative relational dynamics, as well as with individuals born and raised within high-risk groups, who
often experienced horrific abuse and violence. On the other hand, even the judicial reports inform us on
horrific cases occurred inside abusive cultist movements. An example which hit the international headlines
is that of the murderous group called "Le bestie di Satana" (The Beasts of Satan), whose followers are guilty
of the macabre murder of some young people, who were members of the same organisation including the
minor Fabio Tollis (3).
While we are writing this letter, criminal proceedings are ongoing against Rodolfo Fiesoli, the founder of
the Forteto Community, and others who are accused of sexual abuse on minors. Forteto is a community for
the custody of minors but, as clearly shown in the recent and substantial investigation by the Commission
of Inquiry of Tuscany (4), it was considered as a real abusing cult. The founder, known as "the Prophet" has
been able to act undisturbed for over forty years, despite the fact that in 1976 he had been arrested at the
request of judge Carlo Casini, who opened proceedings for sexual abuse occurred in the community. In the
80’s some Board and parliamentary inquiries underlined the undue influence on the young community’s
guests. Later, in 1985 the Court of Appeal of Florence sentenced Fiesoli - judgement confirmed by the Court
of Cassation- to two years of imprisonment for abuse, violent acts and corruption of minor. (Judgement
which pointed out "the incitement by Forteto’s members to the breakdown of relationships between the
children entrusted to them and their biological parents" and the incitement to "a common practice of
homosexuality"). Again, on 13th July 2000, the European Court of Human Rights condemned Italy to pay a
fine of 200 million Liras as compensation for moral damages after entrusting two children to Forteto
community. In the judgement (case Scozzari and Giunta against Italy - appeal No. 39221/98 et 41963/98),
the Court deemed appropriate to comment that the fact that people convicted for maltreatment and abuse
could still play an active role in the community raised serious doubts. In December 2011, Rodolfo Fiesoli
was finally arrested again for maltreatment and abuse of children entrusted to Forteto community and on
4th October 2013 the trial against the leader of this "community-cult" and other 22 suspected persons was
started in Florence.
In Italy, as a result of a plea of unconstitutionality, the Constitutional Court, by judgement No. 96 dated 8th
June 1981, quashed the criminal offense of plagiarism from the legal system, because it was in contrast
"with the principle of compulsory nature of the case, contained in absolute reservation of law in criminal
matters, enshrined in Art. 25 of the Italian Constitution". The Constitutional Court therefore established the
vagueness of the wording of the criminal offense of plagiarism <<claiming the non-verifiability of the fact
considered in this case, the impossibility of its assessment with logical and rational criteria, the intolerable
risk of unlawful acts>>.
After over thirty years from the repeal of the offense of plagiarism, however, in the social community, the
need for protection of man’s individual personality and his psycho-physical integrity is more and more
important: in short, the need for the protection of the individual identity as thinking, unique and
unrepeatable human being. This means in particular, to protect the human being, at the time of formation
and development of his personality, from "obsessive" interference and also protect him from various
behaviors which may compromise his integrity, that of his psyche and his social functionality. Furthermore,

all these needs, as well as finding implicit recognition in Articles 2 and 3 of the Italian Constitution, establish
the basic prerequisite so as the rights of freedom can be effectively enjoyed and the duties of solidarity
consciously fulfilled, which the Constitution ensures and requires (*). As noted by distinguished jurists too,
after the repeal of the offense there was a dangerous gap in the protection of personality against
plagiarism, and even the rules of the Criminal Code, such as the "circumvention of incapable" (Article .643
CC), are not applicable to situations involving psychological, behavioral and physiological conditioning of
the followers of cultist movements (**). The Secretariat-General of the Presidency of the Italian Republic
– Office of Legal Affairs and Constitutional Relations - (SGPR Protocol dated 13/6/2007 0066076 P OLA),
reported "…we agree that the repeal of offense of plagiarism due to lack of certainty resulted in a
dangerous regulatory vacuum which should have been filled by appropriate and expeditious legislative
actions."
One of the most important Italian association for protection of minors, Telefono azzurro, which since 2003
has been operating on behalf of the Ministry of Communications, Ministry for Equal Opportunities and
Ministry of Labour, the Servizio emergenza infanzia (Childhood Emergency Service), in its 5th National
Report on the Status of Minors and Adolescents (2005), carried out together with EURISPES (prestigious
Italian Institute which operates in the field of research), observed that "the involvement of minors in cults
is a quite complex phenomenon and difficult to explain: that is why it should not be ignored because, even
though in a barely visible way, minors are involved both as victims (through psychological and sexual abuse)
and offenders (by using alcohol and drugs up to extreme forms of crime). Sexual abuse on minors is a
tangible reality as demonstrated by the figures provided by the Central Direction of the Criminal Police."
Also in the 9th National Report on the Status of Childhood and Adolescence (5) published in 2009, the
rapporteurs of this document highlighted dramatically how "the children victims of cults are children who
"do not exist", forgotten, ignored and denied victims" and is also observed that "children who managed to
get out of cults in which they were subject to abuse and violence can have levels of physical, psychological,
relational, emotional, cognitive and behavioural development which differ very much from the standard:
they seem younger than they are with regard to decision-making capabilities, judgement, memory and
language. The consequences a child who is victim of these cults may experience are countless at various
levels: physical, cognitive, emotional, relational, in constructing their identity…".
In March 2006, an important report entitled "Report on the condition of childhood and adolescence in
Italy" made in draft form by the National Centre of Documentation and Analysis of Childhood and
Adolescence on behalf of the National Monitoring Centre and Ministry of Labour and Social Policies, was
discussed and approved by the National Monitoring Centre for Childhood. In the large section dedicated to
the situation of minors involved in the so-called "cults", on the one hand it was highlighted how the
phenomenon was largely present in our country and the serious implications for minors themselves; on the
other hand, it was highlighted the need to implement appropriate informative prevention policies for
minors’ protection. In the report, it was also highlighted how, after the release of the report called
"Religious cults and new magical movements in Italy" made by the Executive Committee for Information
and Security Services of the Ministry of Interior in February 1998, "the initiatives aimed at "protecting"
these new cults multiplied, the cults started a counteroffensive in the name of religious freedom with
proactive aggressiveness …in addition to the obvious defence strategy, some cults used tactics to tighten
the secrets in various circuits of initiation and, while they are doing public campaigns for religious freedom
in the press and on TV, within internal "private" associations of the initiates, oaths of secrecy and silence

obligations become more and more pressing" and similar "reactions had also occurred after the publication
of the report on cults prepared by the Council of Europe in 1999" (6).
Moreover, according to the report made in 2010 by the working group chaired by Dr. Luca Bernardo
(director of Ambulatorio per il Disagio degli Adolescenti – Surgery for adolescents’ discomfort - at
Fatebenefratelli Hospital in Milan and, at the time, it was president of the Committee for Bullying of
Ministry of Education, Research and University), 240,000 minors and adolescents would have come into
contact, only in that year, with "cults" or groups linked to Satanism (7).
In a recent interview with the well-known Italian magazine Panorama, Dr. Maria Carla Bocchino, 1st Director
in charge of the Analysis Division of the Operational Central Service (SCO), of the State Police, reported the
alarming rise in our country of young people attracted, in particular through the web, by groups of acid
Satanism; these data are also confirmed by the activity of Postal Police. The risk band found among the new
"sympathisers" is between 12 and 22 years old (8).
Notwithstanding, as reported by the member of parliament Rudy Salles, unfortunately only some Member
States appear to have accepted, and to the present day, the information contained in the many
Recommendations of Parliamentary Assembly of the Council of Europe on the cult phenomenon and in
particular those provided by Recommendation No. 1412 (1999), we bitterly must confirm that neither our
country has taken measures about the protection of the most vulnerable individuals and of children
involved in cultist movements.
In Italy, Parliamentary Committees aimed at minor victims of cults have never been activated, but only a
Consultation on the phenomenon of mental manipulation of vulnerable individuals with particular
reference to the phenomenon of the so-called cults (9), which unfortunately has not been concluded. The
audition held in the Room of the 2nd standing Judiciary Committee of the Senate of a young woman who
had been part, together with her mother and sister, of a small syncretic cult headed by a charismatic leader
was the most intense and dramatic moment of the investigation carried out by the parliamentary
committee. In the case mentioned, the Court of Cassation, VI Criminal Division (10), showed that "the
second-instance judgement reconstructed the facts of the case and highlighted the unlawful behaviour of
the defendant against the affected parties (including two minors) held for a long period (about three years),
through the forced imposition of food against one of the minors, even by using physical violence, as closing
her nose despite the obvious intolerance, the compulsion to eat again what she had vomited, the frequent
nocturnal awakenings or the absolute impediment to rest in order to participate in the rituals of salvation,
the conditioning of the most basic manifestations of life, as well as threats of "divine" punishments or
serious events in case of disobedience to her directives."
Shocking events, similar to those described, concerning the involvement of minors in cults groups or
organisations were recalled in the Judicial Inspection No. 4-08890 session No. 855 dated 18th December
2012 (16th Legislature), presented by the senators Gallone and Allegrini. However, this question remained
unfulfilled (11).
Currently, no answers have been provided by the questioned departments, not even regarding the new
questions presented by other Italians MPs, who repeatedly urged our leaders to due attention about the
phenomenon in question, noting also, as we read in the texts of Acts of Judicial Inspection (12 and 13) that
only voluntary associations and centres of information and research active in the country perform "a
valuable and continuous work of information on the phenomenon and support to victims and their families;

in this way, they perform a free integration action, which is often a real substitution of the public action, by
taking advantage of the advice and cooperation of experts in the fields of mental health, criminology and
law".
Moreover, as it can be seen from the following extract of the same texts, "a repeated and serious libellous
campaign committed particularly on web network has been carried out, through which some subjects, as
well as minimize the aforementioned social phenomenon, systematically discredit with manifestly false and
tendentious arguments the representatives of the voluntary sector, police forces and institutions involved in
this specific and sensitive field, as well as the victims of controversial and/or abusing realities".
It is not our intention to enter into the merits of considerations concerning the several letters criticising the
Report of MP Rudy Salles, which were addressed to your attention and which we learn about on the
Internet, fully aware that appropriate assessments are under the responsibility of the recipients, however,
as regards the letter of the Italian scholar Dr. Raffaella Di Marzio, which in particular refers to
discrimination phenomena that have been occurring for three decades in our country against religious
and/or spiritual minorities and against children belonging to these minorities, we cannot avoid highlighting
that these assertions have no basis and objective feedback. No national or European report, not even the
American report on religious freedom, have ever reported the existence of discriminatory acts occurred in
Italy against religious and/or spiritual minorities and against children belonging to minority groups; rare
episodes of intolerance, in particular against the faithful affiliated to majority groups, have been reported.
The promotion and protection of people belonging to religious and spiritual minorities and the defence of
religious and cult freedom are, however, among the priorities of the Italian domestic and foreign policy.
Publicly supporting facts which are completely unfounded not only disconcerts the undersigned, but also
can give rise, in terms of public opinion, to pernicious alarmism.
We believe that the worried words of one of the world’s leading experts of the phenomenon, Dr. Michael
Langone, Executive director of the International Cultic Studies Association (ICSA), can summarise the
serious situation which a lot of children, victims of these high-risk groups, are living "Investigation of this
field has at times been upsetting. The abuses to which children have been subjected can be horrendous…
And the lack of concern and action about this problem is shameful.." (14)
Sure of interpreting, also and above all, the feelings of those people we are assisting and protecting with
our activity, we hope that the commendable work done by the rapporteur Rudy Salles concerning the
protection of minors against the excesses of cults is favourably accepted so that every individual can
actually enjoy the right to exist as a child and to grow up as a free man.

Preg.mi Signori,
in data 3 marzo 2014 è stato adottato dalla Commissione Affari Giuridici e dei Diritti dell’Uomo
dell’Assemblea Parlamentare del Consiglio d’Europa, un importante Rapporto sulla protezione dei
bambini dagli eccessi delle cosiddette derive settarie, frutto del lungo e accurato impegno del relatore
francese Rudy Salles.
Gli studiosi, le associazioni italiane di tutela dei diritti dei bambini, i centri e le associazioni di ricerca,
informazione e difesa dell’individuo e delle famiglie da gruppi ad alto rischio che unitamente
sottoscrivono questa lettera, desiderano esprimere sentita gratitudine e apprezzamento per il contenuto
del Rapporto, che, nella fattispecie, individua e suggerisce indispensabili programmi e politiche
d’intervento e/o il loro rafforzamento, col fine di fronteggiare con efficacia il pericolo rappresentato delle
cosiddette derive settarie e tutelare concretamente l’interesse superiore del bambino da ogni forma di
brutalità, maltrattamento e negligenza.
Non possiamo che auspicarne l’approvazione, certi che l’Assemblea Parlamentare e il Consiglio d’Europa
rivestono un ruolo fondamentale per il contrasto a un inquietante fenomeno sociale che risulta in
costante crescita e coinvolge, anche attraverso l’accresciuto utilizzo della rete internet, un numero
sempre maggiore di adolescenti e minorenni.
Contributi scientifici internazionali, riferiscono concordemente che minori inseriti in contesti settari
abusanti subiscono sovente la sistematica violazione di tutti i loro diritti fondamentali (Paul Martin,
Michael D. Langone e Gary Eisenberg, Markowits e Halperin, Susan Landa, Stephen A. Kent e Doni
Whitsett, Singer e Lalich, etc. ), così come la recente ricerca di Jill Mytton pubblicata dalla The British
Psycological Society (1), ha rilevato che bambini nati o cresciuti in gruppi ad alto rischio presenteranno
significativi problemi di natura psicologica e psico-sociale non solo dopo l’uscita dal gruppo ma anche in
età adulta. Inoltre, sulla base dei risultati dell’accurato studio condotto dall’Università di Toronto (2), i
bambini vittime di realtà coercitive presenteranno tempi di remissione prolungati delle sindromi
depressive, rispetto coloro che non hanno subito tale tipo di traumi. Per quanto di conoscenza, è inoltre
in corso un altro importante progetto di ricerca approvato dalla Human Subjects in Research Committee
at California State University, titolato "On Our Own: How Children of Cults Manage to Survive in the

‘Outside’ World" a cura della dott.ssa Jania Lalich, riconosciuta esperta internazionale di culti e gruppi
estremisti.
Nella nostra attività sul campo siamo quotidianamente a contatto con persone vittime di organizzazioni
totalitarie e dinamiche relazionali manipolative, nonché con individui nati o cresciuti in gruppi ad alto
rischio che hanno sperimentato abusi e violenze non di rado raccapriccianti. D’altra parte le stesse
cronache giudiziarie ci informano di casi agghiaccianti avvenuti nell’alveo di movimenti cultistici abusanti.
Un esempio balzato alle cronache internazionali è quello del gruppo omicida denominato Le Bestie di
Satana, i cui adepti si sono macchiati del macabro assassinio di alcuni giovani, anche affiliati alla stessa
organizzazione, tra cui il minore Fabio Tollis (3)
Nello stesso momento in cui redigiamo questa lettera, è in corso un procedimento penale contro il
fondatore della comunità il Forteto, Rodolfo Fiesoli più altri, accusati di maltrattamenti e abusi sessuali su
minori. Il Forteto è una comunità di affido minori, ma, come inequivocabilmente evidenziato nella
recente e corposa indagine svolta dalla Commissione d’inchiesta della Regione Toscana (4), si
caratterizzava come una vera e propria setta abusante. Il fondatore, soprannominato "il Profeta", ha
potuto agire indisturbato per oltre quarant’anni nonostante già nel lontano 1976 l’uomo fosse stato
arrestato su richiesta del giudice Carlo Casini che aveva aperto un procedimento per abusi sessuali
avvenuti nella comunità. Negli anni ’80 alcune interrogazione consiliari e parlamentari ponevano già in
luce l’azione di indebita influenza posta in essere verso i piccoli ospiti della comunità. Successivamente,
nel 1985 la Corte di Appello di Firenze aveva emesso contro Fiesoli sentenza di condanna, -confermata in
Cassazione-, a due anni di reclusione per maltrattamenti, atti di libidine violenta e corruzione di
minorenne. (Sentenza che evidenziò, tra l’altro, "l’istigazione da parte dei responsabili del Forteto alla
rottura dei rapporti tra i bambini che erano loro affidati e i genitori biologici", e l’istigazione a "una pratica
diffusa di omosessualità"). Ancora in data 13 luglio 2000 la Corte europea dei diritti dell'uomo condannò
l'Italia al pagamento di una multa di 200 milioni di lire come risarcimento dei danni morali a seguito
dell'affidamento alla comunità Forteto di due bambini. Nella sentenza (caso Scozzari e Giunta contro Italia
- ricorso n. 39221/98 et 41963/98), la Corte ritenne opportuno commentare che suscitava serie riserve il
fatto che persone condannate per maltrattamenti e abusi su minori potessero ancora svolgere un ruolo
attivo nella comunità. Nel dicembre 2011 Rodolfo Fiesoli è stato infine nuovamente arrestato con l’accusa
di maltrattamenti e abusi su bambini affidati al Forteto e il 4 ottobre 2013 si è aperto a Firenze il processo
contro il leader di questa "comunità-setta" e altri 22 indagati.
In Italia, a seguito di un’eccezione di incostituzionalità, la Corte Costituzionale, con sentenza n. 96 dell’8
giugno 1981, ha opportunamente cassato il reato di plagio dall’ordinamento giuridico penale perché in
contrasto «con il principio di tassatività della fattispecie, contenuto nella riserva assoluta di legge in
materia penale, consacrato nell’articolo 25 della Costituzione ». La Corte Costituzionale ha pertanto
sancito l’indeterminatezza della formulazione della fattispecie criminosa del reato di plagio <<adducendo
essenzialmente l’inverificabilità del fatto contemplato dalla fattispecie, l’impossibilità comunque del suo
accertamento con criteri logico-razionali, l’intollerabile rischio di arbìtri dell’organo>>.
A oltre trent’anni dall’abrogazione del reato di plagio è tuttavia sempre più avvertita, nella comunità
sociale, l’esigenza di una protezione della personalità individuale dell’uomo e della sua integrità psicofisica:
in sintesi, la necessità di una tutela dell’identità di essere pensante, unico e irripetibile
dell’individuo. Ciò vuol dire, in primis, proteggere l’essere umano, nel momento di formazione e sviluppo
della sua personalità da ingerenze "ossessive" e inoltre tutelarlo dai vari comportamenti che ne possano
compromettere la sua integrità, quella della sua psiche oltre alla sua funzionalità sociale. Peraltro, tutte
queste esigenze, oltre a trovare implicito riconoscimento negli artt. 2 e 3 della Costituzione, costituiscono
il presupposto di base perché possano essere effettivamente fruiti quei diritti di libertà e
consapevolmente adempiuti i doveri di solidarietà che la Costituzione garantisce e impone (*). Come del
resto rilevato anche da insigni giuristi, dopo l’abrogazione del reato si è dunque venuto a creare un
pericoloso vuoto di tutela della personalità nei riguardi delle dinamiche plagiarie, né le norme

contemplate nel vigente codice penale, quali la circonvenzione di incapaci (art.643 c.p.) risultano di fatto
applicabili a situazioni comportanti il condizionamento psicologico, comportamentale e fisiologico degli
adepti di movimenti a carattere settario. (**) Lo stesso Segretariato Generale della presidenza della
Repubblica -Ufficio Affari Giuridici e Relazioni costituzionali- (Protocollo SGPR 13/6/2007 0066076 P
UAG), ha così riferito "..si condivide che l’abrogazione del reato di plagio per difetto di determinatezza
abbia comportato un pericoloso vuoto normativo che avrebbe dovuto essere colmato da adeguate e
sollecite iniziative legislative".
Una delle più importanti realtà associative italiane per la tutela dei minori, il Telefono Azzurro, che dal
2003 gestisce per conto del Ministero delle Comunicazioni, Ministero per le Pari Opportunità e Ministero
del Lavoro, il Servizio emergenza infanzia, già nel suo 5° Rapporto Nazionale sulla Condizione dei Minori
e degli Adolescenti (2005), realizzato con Eurispes, (prestigioso istituto italiano che opera nel campo della
ricerca), rilevava che "Il coinvolgimento di minori nelle sette è fenomeno alquanto complesso e difficile da
descrivere: per questo non va trascurato, poiché, anche se in modo poco visibile, i minori vi sono coinvolti
sia come vittime (attraverso abusi psicologici e sessuali), sia come autori di reato (con l’uso di alcol e
droghe fino a forme estreme di crimine). L’abuso sessuale sui minori è una realtà tangibile, come
denunciano i numeri forniti dalla Direzione Centrale della Polizia Criminale "
Altresì nel 9° Rapporto Nazionale sulla Condizione dell’Infanzia e dell’Adolescenza (5) pubblicato nel
2009, i relatori del documento hanno drammaticamente sottolineato come "i bambini vittime delle sette
sono bambini che "non esistono", vittime dimenticate, ignorate e perfino negate", e altresì constatato che
" i bambini che sono riusciti ad uscire da sette nelle quali hanno subìto abusi e violenze possono avere
livelli di sviluppo fisico, psicologico, relazionale, emotivo, cognitivo e comportamentale che si discostano
molto dalla norma: sembrano più piccoli di quello che effettivamente sono per ciò che concerne le capacità
decisionali, di giudizio, la memoria e il linguaggio. Innumerevoli sono le conseguenze cui un bambino
vittima di queste sette può andare incontro, a vari livelli: fisico, cognitivo, emotivo, relazionale, di
costruzione della propria identità.."
Nel marzo 2006 veniva discussa e approvata dall’Osservatorio Nazionale per l’Infanzia, una importante
relazione realizzata in forma di bozza dal Centro nazionale di documentazione e analisi per l’infanzia e
l’adolescenza per conto dello stesso Osservatorio nazionale e del Ministero del Lavoro e delle Politiche
Sociali titolata "Rapporto sulla condizione dell’infanzia e dell’adolescenza in Italia". Nell’ampio capitolo
dedicato alla situazione dei minori coinvolti nelle cosiddette "sette", si evidenziava, da un lato, come il
fenomeno fosse presente in larga misura nel nostro paese e le gravi implicazioni per gli stessi minori,
dall’altro, come occorresse pervenire all’attuazione di adeguate politiche preventive informative a fattiva
tutela dei bambini. Nel testo si sottolineava inoltre come dopo la diffusione del Rapporto denominato
"Sette Religiose e nuovi movimenti magici in Italia" predisposto dal Comitato esecutivo dei servizi di
informazione di sicurezza del Ministero dell’Interno nel febbraio 1998, si fossero "moltiplicate le iniziative
a "difesa" dei nuovi culti, i quali, con intraprendente aggressività hanno iniziato una controffensiva in
nome delle libertà religiose… Oltre alla strategia di difesa palese, alcuni culti hanno messo in atto tattiche
per rendere più rigorosi i segreti nei vari circuiti di iniziazione e mentre svolgono campagne pubbliche a
favore della libertà religiosa sulla stampa e in TV, nei circoli interni "privati" degli iniziati, i giuramenti di
segretezza e gli obblighi al silenzio si fanno più pressanti" e come analoghe "reazioni si ebbero anche in
seguito alla pubblicazione nel 1999 del rapporto in materia di sette predisposto dal Consiglio d’Europa" (6)
Inoltre secondo il Report realizzato nel 2010 dal gruppo di lavoro presieduto dal dott. Luca Bernardo,
(direttore dell'Ambulatorio per il Disagio degli Adolescenti presso l’Ospedale Fatebenefratelli di Milano e
all’epoca presidente della Commissione bullismo del Ministero dell’Istruzione, Ricerca e Università), ben
240mila minori e adolescenti sarebbero entrati in contatto, solo in quell’anno, con "sette" e gruppi legati
al satanismo (7).

In una recente intervista rilasciata al noto periodico italiano Panorama, la stessa dott.ssa Maria Carla
Bocchino, I° dirigente Responsabile Divisione Analisi dello Sco, Servizio Centrale Operativo, della Polizia di
Stato, ha riferito del preoccupante aumento nel nostro paese, di giovani attirati, in particolare attraverso
la rete web, da gruppi di satanismo acido; dati che trovano peraltro conferma anche dall’attività di Polizia
Postale. La fascia di rischio individuata tra i nuovi "simpatizzanti" risulta quella compresa tra i 12 e 22
anni. (8)
Ciò nonostante, come riferito dal deputato Rudy Salles, purtroppo solo alcuni Stati membri risultano aver
recepito, a oggi, le indicazioni contenute nelle molteplici Raccomandazioni dell’Assemblea Parlamentare
del Consiglio d’Europa sul fenomeno settario e in particolare quelle previste nella Raccomandazione
n.1412 (1999), e con amarezza dobbiamo confermare che anche il nostro Paese non ha purtroppo
adottato misure volte, in particolare, alla tutela dei soggetti maggiormente vulnerabili e dei bambini
inseriti in movimenti a carattere settario.
In Italia non sono mai state attivate commissioni parlamentari aventi a oggetto i minori vittime di derive
settarie, ma unicamente una Indagine conoscitiva sul fenomeno della manipolazione mentale dei
soggetti deboli con particolare riferimento al fenomeno delle cosiddette sette (9), purtroppo non
pervenuta a conclusione. Proprio l’audizione tenutasi presso l’Aula della 2a Commissione permanente
Giustizia del Senato, di una giovane che aveva fatto parte da bambina, insieme alla madre e alla sorella
anch’ella minore, di un piccolo gruppo sincretico a carattere settario capeggiato da una leader
carismatica, ha indubitabilmente costituito il momento più intenso e drammatico dell’indagine svolta
dalla commissione parlamentare. Nel caso accennato, la Corte di Cassazione VI Sezione penale (10),
aveva evidenziato che "la sentenza di secondo grado ha ricostruito i fatti di causa ed evidenziato la
condotta antigiuridica tenuta per un lungo periodo di tempo (circa tre anni) dell’imputata nei confronti
delle parti lese (fra le quali, due minorenni), attraverso la forzata imposizione del cibo nei confronti di una
minore, anche mediante un atto di violenza fisica, quale la chiusura del naso, nonostante l’evidente
intolleranza alla sua assunzione, la costrizione a mangiare di nuovo quanto da lai veniva vomitato, i
continui risvegli notturni o l’assoluto impedimento al riposo per partecipare a rituali salvifici, il
condizionamento delle più elementari manifestazioni di vita, nonché le minacce di punizioni divine o di
gravi accadimenti in caso di disobbedienza alle sue direttive"
Sconvolgenti vicende, analoghe a quelle descritte, ovvero inerenti il coinvolgimento di soggetti minori in
gruppi od organizzazioni a carattere settario, sono state richiamate nell’Atto di Sindacato Ispettivo n. 4-
08890 seduta n. 855 del 18 dicembre 2012, (16° Legislatura), presentato dalle senatrici Gallone e
Allegrini. Tuttavia l’interrogazione in questione è rimasta lettera morta (11)
Al momento non sono state fornite risposte da parte dei dicasteri interpellati neanche alle nuove
interrogazioni presentate da altri parlamentari italiani che più volte hanno inteso sollecitare i nostri
governanti alla dovuta attenzione verso il fenomeno in oggetto, osservando inoltre, come si legge nei testi
degli atti di sindacato ispettivo in questione (12 e 13), che unicamente le associazioni di volontariato e i
centri di informazione e ricerca attivi sul territorio nazionale svolgono "una preziosa e continuativa opera
informativa sul fenomeno e di supporto alle vittime e alle famiglie e in tal senso realizzano un'azione di
integrazione nonché, spesso, di vera e propria supplenza dell'azione pubblica, in maniera del tutto gratuita
e avvalendosi della consulenza e collaborazione di esperti del settore della salute mentale, della
criminologia e della giurisprudenza".
Per di più, come si evince dal seguente estratto dai medesimi testi, è in corso "una pressante e reiterata
campagna dai toni marcatamente diffamatori attraverso cui alcuni soggetti, oltre a minimizzare il
suddetto fenomeno sociale, screditano sistematicamente con argomentazioni tendenziose e palesemente
mendaci i rappresentanti del mondo del volontariato, delle forze dell'ordine e delle istituzioni impegnati in
questo specifico e delicato settore, nonché le stesse vittime di realtà controverse e/o abusanti ";

Non è nostro intento entrare nel merito di considerazioni inerenti le varie missive di critica al Rapporto
del deputato Rudy Salles, inoltrate alla vostra attenzione e di cui apprendiamo dalla rete internet,
consapevoli che le opportune valutazioni competono esclusivamente ai destinatari, tuttavia, in
riferimento a quanto si può leggere nella lettera della studiosa italiana dott.ssa Raffaella Di Marzio, che,
nello specifico, riferisce di fenomeni di discriminazione che si verificherebbero da un trentennio nel
nostro paese nei confronti delle minoranze religiose e/o spirituali e verso i bambini appartenenti a tali
minoranze, non possiamo certamente esimerci dall’evidenziare che si tratta di asserzioni prive di
qualunque fondamento e riscontro oggettivo. Nessun rapporto nazionale né europeo così come lo stesso
rapporto americano sulla libertà religiosa, hanno mai denunciato l’esistenza di atti discriminatori
verificatisi in Italia nei confronti delle minoranze religiose e/o spirituali e dei minori appartenenti a gruppi
minoritari; sono stati invero segnalati rari episodi di intolleranza in particolare nei confronti di fedeli
affiliati a confessioni maggioritarie. La promozione e la tutela degli appartenenti a minoranze religiose e
spirituali e la difesa della libertà religiosa e di culto costituiscono, per contro, una delle grandi priorità
della politica interna ed estera italiana. Sostenere pubblicamente fatti del tutto infondati non solo
sconcerta gli scriventi ma può ingenerare, a livello di pubblica opinione, perniciosi allarmismi.
Crediamo che le preoccupate parole di uno dei massimi esperti mondiali del fenomeno, il dott. Michael
Langone, Direttore Esecutivo dell'International Cultic Studies Association (ICSA), possano riassumere la
grave situazione in cui si trovano tanti bambini vittime di gruppi ad alto rischio "L’Indagine in questo
campo è stata talora sconvolgente. Gli abusi cui i bambini sono stati sottoposti possono essere orrendi ... E
la mancanza di preoccupazione e di azione rispetto a questo problema è vergognoso" (14)
Certi di interpretare, anche e soprattutto, il sentire di coloro che con la nostra attività siamo impegnati ad
assistere e tutelare, auspichiamo che il lavoro encomiabile svolto dal relatore Rudy Salles in tema di
protezione dei minori dagli eccessi delle derive settarie, trovi favorevole accoglimento affinché ogni
individuo possa concretamente godere del diritto di esistere come bambino e di crescere come uomo
libero.
